Irony: Government That Spies on Everyone Accuses Employers of Improperly Using Criminal Background Checks

The relentless government intrusion into every facet of our lives continues unabated. They don’t even have the slightest sense of shame or get the irony in the wake of the NSA revelations and Obama’s IRS scandal. Yet here we have people actually looking to hire in this moribund economy and they’re getting hassled by the stormtroopers from the EEOC.

Federal regulators Tuesday accused two large employers of improperly using criminal-background checks in hiring, the latest salvo in a contentious debate over whether such screening amounts to discrimination against black applicants.

In complaints filed in federal courts in Illinois and South Carolina, the Equal Employment Opportunity Commission said two companies discount retailer Dollar General Corp. and a U.S. unit of German auto maker BMW AG  generally barred potential employees based on the criminal checks, when they should have reviewed each applicant. The commission said the policies had the effect of discriminating against black applicants.

Oh, it’s raaaaacist. Now we get it. So what is the EEOC saying, blacks are more likely to be criminals? Now that would be racist, right? But let’s face it. In modern America you just can’t win. If you’re not hiring you’ll be harassed by the left, and if you use wise business judgment and avoid hiring undesirables, then you’re racist. Heads they win, tails you lose.

The suits underscore increasing government scrutiny of criminal and credit checks, which are widely used to screen job applicants. Some 92% of employers use criminal-background checks for some or all job openings, according to a 2010 survey by the Society of Human Resource Management.

It’s OK, apparently, for the federal government to scrutinize everything you do, yet if you protect yourself by hiring wisely, you’re the bad guy. You just can’t win. But you know who should start doing better background check on employees? The federal government.

    It is certainly true that the percentage of protected minorities who are convicted of crimes is higher than their percentage in the general population. It is also true that the percentage of protected minorities who commit crimes is higher than their percentage in the general population. So, maybe it isn’t racism; maybe it’s criminal activity on the part of individuals within the protected minority population. Is that possible? Yeah, I think that it is; even likely.

    Circumventing common-sense explanations like that is the reason that the “disparate impact” measurement was made the law by liberal appellate court judges. If you can prove that it adversely affects protected minorities more than their percent of the population, then you don’t have to prove anything else. Why? Because it is then legally presumed to arise out of racism and evidence to the contrary is forbidden. Nice for someone; isn’t it? Oh, but not nice for white people and that is the point of it.

    What if someone is white and has a record? Obviously the company would be racist for not hiring them? Or if someone is black but hasn’t committed any crimes, does that make them racist too?

    Probably according to these idiots. But hopefully once they start making money and realizing a third of his paycheck goes towards paying for the lifestyle of his lazy neighbors, he might start looking into the republican party.
